1. About SOBERX

SOBERX is a sobriety and addiction recovery toolkit operated by Phoenix Luna Investments Limited, a company registered in England and Wales ("we", "us", "our").

SOBERX provides tools to support your recovery journey, including a sobriety counter, AI recovery companion (HAL), journalling, community features, meditations, and educational content.

2. Eligibility

You must be at least 18 years old to use SOBERX. By creating an account, you confirm that you are 18 or over.

3. Your Account

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us immediately at [email protected] if you suspect unauthorised access to your account.

You may not create an account on behalf of another person or use SOBERX for any unlawful purpose.

4. Subscriptions and Payments

SOBERX offers a free tier and a Pro subscription. The following features require a Pro subscription: HAL 2.0 AI Recovery Coach, guided meditations, and weekly recovery letters.

Auto-renewal

Subscriptions automatically renew at the end of each billing period unless cancelled at least 24 hours before the renewal date. Your Apple ID account will be charged for renewal within 24 hours prior to the end of the current period.

Managing your subscription

You can manage or cancel your subscription at any time through your Apple ID account settings. Cancellation takes effect at the end of the current billing period — you will retain access to Pro features until then.

Refunds

All purchases are processed by Apple via the App Store. Refund requests must be made directly to Apple in accordance with their refund policy.

Price changes

We may change subscription prices with reasonable notice. Existing subscribers will be notified before any price change takes effect.

5. HAL AI Recovery Companion

HAL 2.0 is an AI-powered recovery companion powered by Anthropic's Claude AI. By using HAL, you agree to the following:

• HAL is not a licensed therapist, counsellor, or medical professional
• HAL's responses are AI-generated and should not be treated as professional medical or mental health advice
• Your messages to HAL are sent to Anthropic's API to generate responses — see our Privacy Policy for full details
• Do not share sensitive personal information (such as financial details or third-party passwords) with HAL
• If you are in crisis, use the in-app SOS button or call Samaritans on 116 123

6. Community Features

SOBERX includes a community feed where users can post messages visible to other users. By posting in the community, you agree to:

• Only post content that is lawful, respectful, and appropriate for a recovery community
• Not post content that is abusive, harassing, discriminatory, or promotes substance use
• Not post personal information about other people without their consent
• Not impersonate other users or organisations

We reserve the right to remove content that violates these terms and to suspend or terminate accounts that repeatedly breach community standards.

7. Acceptable Use

You may not use SOBERX to:

• Violate any applicable law or regulation
• Attempt to gain unauthorised access to any part of the app or its infrastructure
• Interfere with or disrupt the app or its servers
• Scrape, copy, or reproduce any part of the app without our written permission
• Use the app in a way that could harm other users, particularly those in vulnerable recovery situations

8. Intellectual Property

All content within SOBERX — including text, graphics, the HAL system, meditations, and the SOBERX brand — is owned by or licensed to Phoenix Luna Investments Limited. You may not reproduce, distribute, or create derivative works from any content without our written permission.

Your personal recovery data (journal entries, mood logs, photos) remains yours. We do not claim ownership of content you create within the app.

9. Disclaimer of Warranties

SOBERX is provided "as is" without warranties of any kind, express or implied. We do not warrant that the app will be uninterrupted, error-free, or that any defects will be corrected.

We make no warranty that SOBERX will support your recovery or that outcomes described in the app (such as health improvements associated with sobriety) will apply to your specific situation.

10. Limitation of Liability

To the fullest extent permitted by law, Phoenix Luna Investments Limited will not be liable for any indirect, incidental, special, or consequential damages arising from your use of SOBERX, including but not limited to loss of data, loss of profits, or harm arising from reliance on AI-generated content.

Our total liability to you for any claim arising from these terms or your use of SOBERX will not exceed the amount you paid us in the 12 months preceding the claim.

11. Termination

You may stop using SOBERX and delete your account at any time. We may suspend or terminate your account if you breach these terms, with or without notice depending on the severity of the breach.

Upon termination, your right to use SOBERX ceases immediately. We will handle your data in accordance with our Privacy Policy.

12. Changes to These Terms

We may update these terms from time to time. We will notify you of material changes via the app or by email. Continued use of SOBERX after changes are posted constitutes acceptance of the updated terms.

13. Governing Law

These terms are governed by the laws of England and Wales. Any disputes will be subject to the exclusive jurisdiction of the courts of England and Wales.
